On Monday, Federal Court Judge Michael Telesca dismissed three counts of a seven-count civil lawsuit brought against the Town of the Greece and former Greece Police Sergeant Nicholas Joseph.
Nick Joseph is serving time in prison for a hit and run crash on Route 390 in June 2008. Joseph was high and drunk when he struck a vehicle driven by Alexis Sharp. Sharp was pregnant at the time and the impact of the crash forced her to deliver her baby three months prematurely.
Joseph is in jail after being found guilty of four felonies and two misdemeanors related to the June 2008 hit-and-run crash. Judge Francis Affronti found Joseph guilty of being high on alcohol and drugs and leaving the scene of the wreck. One of the victims, Alexis Sharp, was pregnant at the time and was forced to deliver her baby prematurely.
According to court papers, the three counts dismissed included the Town of Greece and the Greece Police Department’s alleged facilitation of Joseph’s dangerous conduct, the denial of evidence in the Joseph crash and that the town and police department conspired to violate her constitutional rights.
This lawsuit was brought by the grandmother of the baby.
No trial date has been set to resolve the lawsuit.
